Book 3, Pay for 2 – Terms & Conditions

Offer includes Book 3 nights, Pay for 2 (1 complimentary night) and Book 4 nights, Pay for 3 (1 complimentary night).
For bookings longer than 4 nights, guests may contact the team to request a complimentary night be applied (subject to approval and availability).
Valid for new bookings only, made on or before 31 March (inclusive).
The Brooklet may pause, end, or amend this promotion at any time without notice.
Offer is subject to availability and may not apply to blackout dates or peak periods (at The Brooklet’s discretion).
Complimentary night is not redeemable for cash, not transferable, and if the booking is amended to fall below the minimum stay requirement, the promotion may be removed and standard rates will apply.

1) Introduction

(a) “you” or “your” means the guest making the booking and all members of the guest’s party.

(b) “we”, “our” or “us” means The Brooklet and its related parties.

By confirming a booking, you agree that:

You and your guests will comply with these Terms & Conditions
If you or your guests breach these Terms & Conditions, you will be liable for any resulting loss or damage, and you authorise us to charge your nominated credit card or deduct from your security bond.
We may evict you and your guests immediately and without refund for any material breach.

2) Bookings

Bookings can be made via our website, by email or phone. A booking is only confirmed once payment of the deposit has been received and we have issued written confirmation.

3) Deposit and Final Payment

A 50% non-refundable deposit is required at the time of booking.
The balance (50%) is due 30 days prior to arrival. If your booking is made within 30 days of arrival, full payment is required at the time of booking.
Bookings must be supported with valid identification and credit card.

4) Payment Policy

Full payment must be received at least 30 days before arrival. Failure to do so may result in cancellation without refund.
Refunds (where applicable) will be processed to the original card used.

5) Cancellation Terms and Charges

Deposits and final payments are non-refundable except as required by law.
Cancellations within 30 days of arrival will incur a charge of 100% of the total booking fee.
All cancellations must be provided in writing.
We strongly recommend comprehensive travel insurance.

6) Security Bond

Villas: $1,000
Exclusive hire: $5,000
Bonds are pre-authorised one week before check-in.
Deductions may apply for damage, lost items, unauthorised use, or excessive cleaning.
You will be notified of any bond charges.

7) Rates and Charges

All rates are in AUD and include GST (where applicable).
Rates may change without notice until a booking is confirmed.
Minimum night stays may apply during certain periods.

8) Check-In and Check-Out

Check-in: 3.00pm | Check-out: 11.00am
Early check-in/late check-out requests are subject to availability and will incur a fee.

9) Children

Children under 16 are not permitted anywhere on the property.
Bookings made in breach of this clause may be cancelled without refund.

10) Number of Persons, Functions & Events

Only the confirmed number of guests may occupy the property.
No outside visitors without prior written approval.
Events/functions must be pre-approved in writing and are subject to additional conditions and fees.
The Brooklet is the exclusive food and beverage caterer for events held onsite.

11) Alcohol

The Brooklet is a licensed premise. Personal alcohol consumption is only permitted within the Villa.
Alcohol consumed in common areas must be purchased via Guest Services.

12) Noise and Behaviour

Guests must not cause nuisance, disturbance, or anti-social behaviour.
Quiet enjoyment of neighbouring properties and other guests must be respected.
Breaches may result in eviction without refund.

13) Inappropriate Bookings

We reserve the right to refuse any booking we reasonably believe is for an inappropriate purpose (e.g., schoolies, parties, or activities likely to cause disruption).

14) Facility Rules

Use of facilities is at your own risk.
No glassware near pools, spas, gym, sauna, or ice bath.
Diving, running, or unsafe behaviour is prohibited.
Management instructions must be followed at all times.
Common facility use is limited to operational hours of 8am – 7pm.

15) Disclaimers and Limitation of Liability

To the maximum extent permitted by law, we are not liable for interruptions to utilities, internet or services beyond our control.
Furnishings and facilities may vary slightly from promotional images but will be of equal or higher standard.
You are responsible for your own conduct and safety while on the property.

16) Force Majeure

We are not liable for cancellations or changes caused by events beyond our reasonable control (e.g., natural disasters, pandemics, government orders, strikes, or Acts of God).

17) Commercial Use

The property must not be used for commercial filming, photography, or any business purpose without prior written consent.

18) No Tenancy

Your booking is for short-term accommodation only and does not create a residential tenancy under NSW law.

19) Parking

Onsite parking is available but used at your own risk.

20) Keypad Locks

You will receive a secure access code valid only for your stay. Sharing access codes with non-guests is prohibited.

21) Linen

Linen, bath towels and pool towels are provided. Additional linen may be supplied on request (fees apply).

22) Internet and Technology

Complimentary WiFi (Starlink) is provided but not guaranteed.
Guests are responsible for use of their own streaming accounts.
Illegal downloading is prohibited.

23) Cleaning

The property must be left in a reasonable state.
Excess cleaning fees may apply if conditions are not met.

24) Rubbish and Recycling

Guests must dispose of excess rubbish and recycling by notifying Guest Services, or in the designated bins before departure.
If excessive rubbish is left, a rubbish removal charge may be incurred.

25) Breakages & Damages

All damages, breakages or losses must be reported immediately.
Costs will be deducted from your bond or credit card.
Furniture and villa items must not be moved. All items must remain within the dedicated villa.

26) Smoking & Vaping

Smoking and vaping are prohibited in all accommodations, communal areas, and facilities.
Evidence of smoking inside will incur a $1,000 cleaning fee.

27) Fire & Emergency

Emergency procedures are outlined in your accommodation.
In case of emergency guests must call 000.

28) Pets

Pets are not permitted. Breaches may incur fees and immediate eviction.

29) Personal Belongings & Lost Property

We are not responsible for loss, theft, or damage to your personal belongings. Guests are advised to secure valuables and obtain travel insurance.
If personal belongings are left at the property and wish to be returned, the guest must arrange a DHL pick up from the property and notify Guest Services who will assist to prepare for collection.

30) Privacy & Data Protection

We collect and store personal information strictly in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.
Your information may be used for booking management, security, and marketing.
We will not share your information with third parties except as required by law.

31) Dispute Resolution

In the event of a dispute, you agree to first attempt resolution directly with us in good faith.
If unresolved, disputes will be referred to mediation in NSW before litigation.
Nothing prevents either party from seeking urgent relief through a court.

32) Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of its courts.
